Terms and Conditions.
This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand the terms and conditions regarding use of your personal data.
GYG.ie Website Terms and Conditions
The GYG.ie Website is the on-line store owned by GYG.ie (“we, “us”, “GYG.ie” or “our”). Access to and use of the part of the GYG.ie Website, www.gyg.ie (the “GYG.ie Website”), designated by us as the GYG.ie Shop is subject to registration and to the following terms and conditions. These terms and conditions set out the agreement between you and us for using and making purchases on the GYG.ie Website.
1. Use of Material appearing on GYG.ie
All rights in the site design, computer codes, text, graphics and other content, interfaces, and the selection and arrangements thereof (the "Materials") belong to GYG.ie or its licensors. You may print or download portions of this site and make copies of these for your own personal use only. Any other use (including without limitation any further reproduction, storage or transmission to anyone) of any Materials without our prior written permission is strictly prohibited. A copy of these terms and conditions can be printed for future reference.
2. GreenYourGoods and You
Econology at work! We are in this to provide a service that finds gaps in the way things are done today, as an Irish business, with a future focus. That said, we believe it needs to be a user focused service and hence we will do everything we can to make this a convenient, pleasant and fair place to do business. We plan to evolve to get better at what we do, and if occasionally we aren't there yet, please accept our apologies!
The following are as fair terms and conditions as we can provide, with the intention being that you, the customer are as protected as possible at all times. Please feel free to contact us on info@GYG.ie with any questions.
3. Terms of Service

GreenYourGoods is a company, to whom You offer to sell your mobile phones, mp3 players, GPS devices, laptop computers, digital cameras, and other items (“Item”) through GYG.ie. By using the GreenYourGoods web site and participating in the service, You agree to the terms and conditions set forth herein. These terms are a legal Agreement between You, and GreenYourGoods, and are collectively referred to herein as the “Agreement.”
Should You not agree to be bound by all the terms and conditions contained in this Agreement, You must refrain from engaging in any business activity with GreenYourGoods or from contacting Us to request information, product, or services.
4. Shipping Your Product to GreenYourGoods
Please use the label provided or freepost envelope. Unfortunately, other than when we arrange a courier collection (see below), we do not accept responsibility for non-delivery of items or damage in transit. We therefore recommend that you send any high value items via registered post to ensure successful delivery. Gadgets that are sent to GreenYourGoods (or our affiliate partners) and payment accepted unfortunately cannot be returned..
5. Tracking Your Item
Once we receive your device and our inspection is complete, we will notify you via email confirming the completion of inspection. This email will either confirm that payment has been approved in the amount of the original quote, or will address any discrepancies with your item.
Once payment is approved, please allow seven (7) business days for processing. If You elect to have the funds paid via PayPal, You will need to use the proper email address for your Paypal account on GreenYourGoods to ensure prompt and accurate payment. GreenYourGoods will not be responsible for any PayPal fees charged to You or any fees charged by your bank. Because banks may have their own rules, regulations and fees applicable to payments and checks, please contact your bank to ensure that the information that You provide GreenYourGoods is accurate.
6. Product Valuation and Payment
All original quotes are based on your description of the device and data gathered through the GreenYourGoods pricing engine. Final determination of the item's value occurs after receipt of your package.
All prices, (payment values) are inclusive of VAT where applicable.
Below is an outline of how we grade your old mobile phones once we receive them.
It is important to try and stick as close to this guide as possible when grading your own mobile phone during the trade-in process in order to avoid disappointment.
To grade your phone, start at “Working” below and tick off the list in its entirety. If any ONE item in a grade is true, then that is its grade.
Please remove any phone locks that require a pin code. Handsets that are received and cannot be fully tested because of a phone lock will not be processed for payment and might not be returned.
- Full working order with a battery
- The phone must turn on and off
- The phone must be fully functional
- The screen must be working and intact
- The phone must not be crushed or water-damage
- PIN Locked
- Badly damaged casing
- No battery
- Handset back/battery cover missing or broken
- Does not power up
- Handset operating system missing or corrupt
- Broken/missing aerial
- Faulty keypad
- SIM Gate broken or missing
- Memory card holder broken or missing
- Charger port not working
- Camera or microphone not working
This list is not exhaustive and GreenYourGoods reserves the right to amend this list at any time.
Beyond Economical Repair (BER)
- Physically broken or in more than one piece!
- Broken/Cracked/Snapped hinges
- Water damaged
- LCD cracked/bleeding/does not work or missing
- Unresponsive touch screen's
- SIM glued in
- Memory card glued in
- Broken battery terminals
- Re-programmed IMEI number**
- Logged by Immobilise/on the IMEI blacklist register**
- Barred by a network**
Mobile phones received in bottom 3 conditions will also be reported to the police.
If a phone fails to meet our terms and conditions we'll propose an adjusted price by email. You will have seven (7) days from the date of the proposed price notification to accept or decline the new offer. If after 7 days you have not responded, we will automatically assume your acceptance of the offer and process payment.
If you choose to decline our new offer within 7 days of the new price proposal, we are happy to return the phone. A minimum delivery charge of €7.00 will be applicable depending on weight and number of phones to be returned.
GreenYourGoods have the final decision on all phone values.
Each mobile phone is tested at our warehouse to ensure the information provided by you is accurate. All phones are tested and recycled in line with ISO 9001 and 14001 procedures. our providers fully adhere to the Waste Electrical and Electronic Equipment Directive (WEEE Directive).
We accept phone battery chargers and accessories. But, these do not increase the value of your order.
You are responsible for cancelling any airtime contract linked to each handset. We are not responsible for any call costs arising before, or after, receipt of your handset, or arising from any other circumstances whatsoever.
Please remove SIM cards before sending us your mobile. Any SIM cards received by us will be destroyed, and so obviously cannot be returned. (We will dispose of them appropriately.) We accept no liability in the event that any phone that has been sent with its SIM card is lost and charges are then incurred. You shall continue to be responsible for such charges.
Please remember that by sending your phone to us, you agree to release us from all and any claims, losses or damages with respect to the phone, any data stored or contained therein or on any media used in conjunction with the phone (whether in the form of personal details, SMS, photos, games, songs or other data ("Data")). We accept no responsibility in relation to the security, protection, confidentiality or use of such data and it is your responsibility to ensure that such data is removed from the phone prior to you sending it to us.
We work with 'Immobilise', a crime protection database that blocks stolen mobile phones and so we check received units via CheckMEND to ensure that the phones that are sent to us are not reported stolen. We do this prior to confirming purchase. However, in the event that we become aware of any issues at any time, we reserve the right to withhold/cancel payment and you agree to co-operate with us and any authorities should we so request.
7. Product Inspection
Upon receipt of the Item, GreenYourGoods uses a rigorous process to inspect the Item. GreenYourGoods reserves the right to accept or deny the Item. GreenYourGoods will use its best discretion to determine the product value. If the Item is consistent with the submission information, with all materials described, and sent to GreenYourGoods in a timely manner (within 14 days of the quote), GreenYourGoods will honor the original quote offered for the product and reflected on the trade in receipt.
In some cases, GreenYourGoods may recalculate the original quote for the item if the item is not in the condition that was originally described. In the event that GreenYourGoods recalculates a quote, you will have to option to accept or reject that new quote within seven (7) days. If you chose to reject the new quote, GreenYourGoods will return the item to you, but will necessarily charge the shipping for the return journey, based on the fact that the initial feedback was knowingly inaccurate. In the event that you do not reject the new offer, GreenYourGoods will automatically accept the Item after the seven day period expires.
8. Stolen or Counterfeit Items
Blocked or Stolen phones” are phones that have been reported as either lost or
blocked or stolen as recorded in any of the stolen asset registers maintained
by CheckMEND at http://www.checkmend.com/geo/index.php.
“Fake” phones are counterfeit phones which are manufactured to resemble products made by another company in breach of Copyright.
GreenYourGoods will make no payments to customers for phones received which are either “Lost, Blocked or Stolen” or “fake”.
GreenYourGoods reserves the right to inform the relevant authorities if there is any suspicion that there is a deliberate attempt to perpetrate a fraud.
the right to reclaim any money paid to the consumer or business if it is
discovered within three months of the return of that phone that the phone has
either been reported lost blocked or stolen by the seller of the phone, or the
phone is discovered to be a “fake”.
9. Transfer of Funds
Green Your Goods offers payments via a cheque or PayPal. Please allow approx 20 days after we receive the item to process your payment.
The contract between you and us is binding on you and us and on our respective successors and assigns. You may not transfer, assign, charge or otherwise dispose of a contract, or any of your rights or obligations arising under it, without our prior written consent.
We may transfer, assign, charge, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract.
You may cancel the contract with us at any time up to the time when you send us the phone ("cooling- off period"), providing:
- the contract was negotiated and concluded exclusively by means of distance communication (including, but not limited to, telephone, letter, fax or email); and
- you are a natural person acting outside the purposes of any business.
When cancelling during the cooling-off period, you need not give us any reason for cancelling the contract, nor will you have to pay any administration charges.
To cancel the contract you must notify us in writing.This contract cannot be cancelled once our payment has been issued to you.
GreenYourGoods will have the final decision on all items
When we receive your order, we will check that it is complete, and that it meets our terms and conditions. Providing it does, we will action payment within 7 working days of receipt of item.
During busy periods it may take longer to process your payment.
Please Note: Payment can only be made to the name, address and details provided when upon registration, or similarly to the Paypal account/email given – PLEASE ENSURE THIS IS ACCURATE AS IT CANNOT BE CHANGED AFTER SUBMISSION.
With regards donations to clubs/groups, these will be issued in a similar timeframe.
If you have damaged your cheque, you can have it reissued, free of charge, by posting us a written request and including the damaged cheque to the following address: If the damaged cheque is not received by us, a cancellation fee will apply and will be deducted from the re-issued cheque value. If you have lost your cheque, you can request for it to be cancelled and re-issued. A cancellation fee may apply and will be deducted from the re-issued cheque value.
10. Item Ownership
In order to use the GreenYourGoods service, you must be at least 18 years of age and must own the right, title, and interest in any and all items that you seek to sell to GreenYourGoods, and all contracts expired or terminated.
11. Passing of Title
Title of the item passes to GreenYourGoods upon arrival and acceptance at GreenYourGoods's processing center. The passing of title is final, and all decisions regarding items are at the sole discretion of GreenYourGoods. In the case that GreenYourGoods offers a new valuation after inspection, you have seven (7) days to accept or reject the new quote. In the event that you do not reject the new offer, GreenYourGoods will automatically accept the Item after the seven day period expires.
Ownership of the phone(s)/gadgets will only pass to us when we receive the phones, in accordance with these terms and conditions, and we have dispatched payment to you, when, hence, a contract will be formed.
12. Legal Terms of Service
You must also be acting on your own behalf, and not as an agent or representative of another individual or company. Such items, or the sale and shipment of such items, must not violate any applicable laws, statutes, ordinances, or regulations including export laws. You are responsible for complying with any and all such laws. Any items You seek to sell through the Site using GreenYourGoods services: (1) shall not infringe on third party intellectual property rights (including copyrights, trademarks, patents, trade secrets or other proprietary rights), (2) shall not be counterfeit, stolen, or fraudulent. You represent and warrant that the products are free of any liens or encumbrances.
By using the GreenYourGoods service, you agree to indemnify GreenYourGoods from all claims or losses sustained by GreenYourGoods as a result of any breach of this warranty.
By placing an order through our site, you warrant that:
- You are resident in the Republic of Ireland; and
- You are legally capable of entering into a binding contract; and
- You are at least 18 years old; or
- If you are under 18 years of age, that you have obtained your parent's or guardian's consent to sell your phone to us for the sum indicated via our website.
Any liabilities or claims that may arise if you send the phone to us in breach of this warranty will not be accepted. Your statutory rights are not affected by this contract.
13. Data Removal
Personal information should remain personal. GreenYourGoods works tirelessly to maintain the highest standards of data security. For all items that use hard drives, memory cards, or other means of storing data, GreenYourGoods uses its best efforts to remove all data, but makes no guarantees in this regard. It is recommended that you remove any data from your devices before the item is sent to GreenYourGoods. By sending your items to GreenYourGoods, you agree to release us from any any claim or liability as to the item and as to the data stored on the item. GreenYourGoods is not responsible for any loss suffered by you as a result of data that is not erased from the device and obtained by a third party.
- You are responsible for cancelling any contracts linked to a mobile. We are not responsible for any call costs arising before, or after, receipt of your handset.
- Please remove SIM cards before sending us your mobile. Any SIM cards received by us will be destroyed in a manner consistent with out operations, We accept no liability in the event that any phone that has been sent with its SIM card is lost.
14. Liability / Indemnification
You agree to indemnify and hold harmless GreenYourGoods and all affiliates, directors, distributors, employees, licensors, officers, owners, and service providers from any claims or damages, including any incidental, indirect, special, consequential, punitive damages, or loss of profit or opportunity; claims, demands, or actions for any subrogation claim brought by Seller's insurance carrier, and, by submitting an item to GreenYourGoods and Seller expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier. By mailing a parcel of material to GreenYourGoods for analysis, the Seller explicitly and expressly accepts this limitation of liability.
1. Accuracy of Information
GreenYourGoods makes every effort to ensure the accuracy of all information presented on its website, literature or any communication. In the event of typographical errors, technical inaccuracies, pricing errors or omissions, GreenYourGoods reserves the right to correct the error. If GreenYourGoods corrects an error that will have a material effect on our settlement offer, GreenYourGoods will provide You with the following options: (1) to continue with the transaction based on the corrected information; or (2) to cancel your transaction, in which case GreenYourGoods will promptly return your shipment.
GYG.ie reserves the right to amend the terms of this Agreement from time to time. Your continued use of any part of the GYG.ie Website after any such amendment will constitute your acceptance of the amendment or amendments concerned. You should therefore regularly visit these terms and conditions to ensure that you keep up to date with your rights and obligations under this Agreement. If any such amendments are considered in the reasonable opinion of GYG.ie to be material, notice of the amendments will be emailed to all registered users of GYG.ie at their e-mail address.

3. Access/Force Majeure
Although we will aim to provide uninterrupted access to the GYG.ie Website, we cannot guarantee this. We accept no responsibility or liability for any interruption or delay which may occur to anyone visiting or wishing to visit the GYG.ie Website.
In the event we cannot fulfil obligations to you under this agreement due to any event beyond our control, we will use reasonable commercial efforts to notify you and we will be relieved of our obligations to you under these terms and conditions to the extent such performance is hindered by such an event.
This Agreement is governed by Irish law and both we and you agree to submit to the exclusive jurisdiction of the Irish courts. If any part of these terms and conditions is determined to be invalid or unenforceable pursuant to applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these terms and conditions shall remain in effect.
